解除雇傭關系的形式之一:Dismissal 解雇
三種解雇的類型:
Actual dismissa l實際解雇 The termination of an employees’ contract by the employer
Deemed dismissal 推斷解雇:勞動合同到期后,沒有續期
The ending of a fixed-term contract without renewal on the same terms.
Constructive dismissal 建設性解雇:是員工自己辭職由于雇主的違背合同(加班不提供三倍工資)
Resignation by employee where the employer’s conduct breaches the contract of employment
兩種違法的解雇方式:
Wrongful dismissal 非法解雇/錯誤解雇:違背勞動合同,即沒有period of notice, 企業沒有按合同提前一個月通知員工被解雇
A claim for wrongful dismissal is a common law action for breach of contract
Unfair dismissal 不公平解雇:解雇理由明顯不合理,比如因員工的性別、年齡、是否懷孕、婚姻狀況而解雇 A dismissal without good reason.
